1. Introduction

These Terms & Conditions apply to all bookings and participation in any Cape Camino experience operated by Cape Camino (Pty) Ltd (“Cape Camino”).

By completing a booking (including submission of the online indemnity form), making payment, or participating in a Camino, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.


2. Booking & Payment

A booking is confirmed only once:

Full payment is required prior to departure unless otherwise agreed in writing.

All prices are listed in South African Rand (ZAR).

Cape Camino reserves the right to adjust pricing prior to booking confirmation.


3. Health & Fitness

Participants acknowledge that walking the Camino involves physical exertion across varied terrain, including gravel roads, farm tracks, and uneven surfaces.

By booking, you confirm that:

Participants walk entirely at their own risk.


4. Indemnity & Waiver of Liability

Completion of the online booking form constitutes acceptance of the following indemnity:


INDEMNITY

I, the undersigned:

A. In my personal capacity as a major adult over the age of 18 years;
B. In my capacity as guardian of my minor child/dependent for and on his/her behalf (“the Indemnity Grantor”),

Hereby acknowledge, agree and undertake in favour of Cape Camino (Pty) Ltd and its committee members, employees, representatives, directors, agents and hosts (“the Indemnified Persons”) that:

4.1 Acknowledgement of Risk

The Indemnity Grantor is fully aware of the nature and extent of the walk/Camino and the risks associated therewith and fully accepts all risks associated therewith.

4.2 Release & Hold Harmless

The Indemnity Grantor hereby releases the Indemnified Persons from all liability and holds each and all of the Indemnified Persons harmless against all claims, damages, injuries, losses, deaths, expenses and liabilities arising out of or in any way connected to the Camino, including without limitation:

4.2.1 Any personal injury or loss of life;

4.2.2 Any loss of support, maintenance or other claims or damages arising from or connected with any personal injury or loss of life to the Indemnity Grantor;

4.2.3 Any loss or damage to clothing or property belonging to the Indemnity Grantor or any third party which may occur whilst the Indemnity Grantor is associated with or participating in the walk/Camino.

This applies whether arising out of strict liability, statute, or otherwise, and whether caused by negligence or gross negligence on the part of the Indemnified Persons or any other person.

4.3 Severability

Each clause of this indemnity is independent and severable from all other clauses.

Each element of the release from liability and/or indemnity in respect of each cause or activity covered by this release shall be separate and severable.

4.4 Acceptance

The acknowledgements, agreements and undertakings in this indemnity are deemed to be made in favour of Cape Camino (Pty) Ltd, its members, employees, representatives, directors, agents and hosts, capable of acceptance at any time.

4.5 Governing Law

This indemnity shall be governed by the laws of the Republic of South Africa. All disputes shall be determined in accordance with South African law.

4.6 Commencement

Indemnity under this agreement commences upon the walk/Camino starting.

4.7 Confirmation

I understand the terms of this indemnity and waiver and agree that all terms contained herein are fair and reasonable.


5. Cancellation Policy

All cancellations are subject to a 10% administration fee, regardless of notice period.
This fee covers planning, coordination, and administrative work already undertaken.

5.1 60 Days or More Prior to Departure

90% refund (10% admin fee retained)

5.2 Between 60 and 30 Days Prior

70% refund

5.3 Between 30 and 14 Days Prior

30% refund

5.4 14 Days or Less Prior to Departure

No refund


Peninsula Route Special Note

Peninsula route accommodation requires full upfront payment to secure bookings.

For these routes, the standard refund policy may not apply. Refunds are subject to host accommodation terms and third-party commitments already made.


6. Rescheduling Policy

Rescheduling is permitted within the same calendar year, subject to availability.

6.1 60 Days or More Prior to Departure

No rescheduling fee (5% admin fee applies)

6.2 Between 60 and 14 Days Prior

10% rescheduling fee

6.3 14 Days or Less Prior to Departure

No rescheduling and no refund


7. Media & Photography

Cape Camino may use photographs or videos taken during the Camino for marketing purposes, including website and social media use.

If you do not wish to appear in marketing material, you must notify Cape Camino in writing prior to your journey.


8. Accommodation & Hosts

Accommodation is provided by independent hosts.

Participants agree to:

Cape Camino is not liable for independent third-party accommodation providers.


9. Personal Responsibility

Cape Camino operates on the principle of personal responsibility.

Participants are responsible for:

If unexpected challenges arise that cannot be resolved independently, participants must contact their host or Cape Camino representative.


10. Travel Insurance

Participants are strongly encouraged to obtain comprehensive travel insurance covering:

Cape Camino is not liable for uninsured losses.


11. Limitation of Liability

Cape Camino’s total liability shall not exceed the total amount paid for the pilgrimage.

Cape Camino shall not be liable for indirect, consequential, or third-party losses.


12. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.
